Terms of Use

By using this website you are deemed to have read and agreed to the following terms and conditions, which are legally binding. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use this website.

The following terms and conditions form the entire agreement between you and IncubatorEurope and were last updated on 8 February 2017.


“Website” means the website innovationtrends.eu.  

“Customer”, “You”, or “Your” refers to you and/or any other person accessing the website and accepting the terms and conditions of use by using the website.

“Company,” “We,” or “Our,” means and refers to the owner and operator of the website innovationtrends.eu, IncubatorEurope s.p.r.l., a Brussels-based company incorporated and existing under the laws of Belgium.

“Product” or “Order” means any purchase that you make through the Website or Company.

“Website Services” refers to all services provided on innovationtrends.eu.

“Content” means text, graphics, images, music, software (excluding the application), audio, video, information or other materials.


EU Funding Profile is an online application that provides you with a personal overview of the European funding programmes you are likely to be eligible for and pieces of legislation that may impact your activities and more generally, that you should be aware of. This overview is automatically generated based on the answers you provide to a questionnaire. The correctness of your answers to the EU Funding Profile questionnaire is your responsibility.

A Customer’s personal overview will always at least consist of:

  • European legislation in force that is likely to have an impact on the Customer’s activities
  • European legislation under development that is likely to have an impact on the Customer’s activities
  • funding programmes and related calls for proposals the Customer is likely to be eligible for

Additionally, depending on the licencing plan you have chosen, you may receive email alerts on developments relating to your personal “EU Funding profile” for 12 (twelve) months.

The database which contains all the data necessary for generating the Customer’s personal overview of relevant pieces of EU legislation and funding instruments, includes information relating to:

  • the most important and most recent pieces of legislation in all sectors that are covered by EU Funding Profile.
  • current (2014-2020) community funding programmes (i.e. the funding programmes centrally managed by the European Commission); former community funding programmes (2007-2013) that still have open calls for proposals and funding programmes from sources other than the European Union.

Information relating to 2014-2020 funding instruments can be subject to change. Funding instruments for which the information is not yet final will be characterised as “In progress”. Structural funds or any other funding programme managed at national level, are currently not considered and excluded from the database.

In order to access the Website Service (personal overview of relevant EU policies and funding programmes), Customers must register to create an account (“EU Funding Profile account”). The Customer’s EU Funding Profile account will be created based upon the personal information provided to us.



The Website and application contain copyrighted material and other proprietary material and information of the company IP. The company IP shall retain all right, title and interest including all intellectual property rights, in and to the Website.

Every content or material made available in any way (online, e-mail, fax, post) in conjunction with the Website falls under the copyright of IncubatorEurope, unless otherwise stated.

Restrictions: User shall not, nor permit any person (including any authorized user) to: (i) reverse engineer, reverse compile, decrypt, disassemble, or otherwise attempt to derive the source code of the Website (except to the extent that this restriction is expressly prohibited by law); (ii) modify, translate, or create derivative works of the Website; (iii) sublicense, resell, rent, lease, distribute, market, commercialize, or otherwise transfer rights or usage to the Website (except as expressly permitted under this Agreement); (iv) remove, modify, or obscure any copyright notices or other proprietary notices or legends appearing on or in the Website, or any portion thereof; (v) transfer or use the Website in violation of any applicable laws, rules, or regulations of any government or governmental agency; (vi) use the Website or any system services accessed through the Website to disrupt, disable, or otherwise harm the operations, software, hardware, equipment, and/or systems of a business, institution, or other entity, including, without limitation, exposing the business, institution, or other entity to any computer virus, trojan horse, or other harmful, disruptive, or unauthorized component; or (vii) embed the Website in any third-party applications.

Markings: The Customer will not remove, alter, or destroy any form of copyright notice, proprietary markings, or confidential legends placed upon or contained within the Website or any component thereof.


You may retrieve and display the Content on any device screen and print individual pages on paper (but not photocopy them) for your personal, non-commercial use. You may not reproduce, modify, store or in any way commercially exploit any of the Content. In particular, but without limiting the general application of the restrictions contained in the preceding sentence, you may not do any of the following without prior written permission from IncubatorEurope:

  • reproduce or store in or transmit to any other website, newsgroup, mailing list, electronic bulletin board, server or other storage device connected to a network or regularly or systematically store in electronic or print form, all or any part of the Content, or
  • publish, transmit, participate in the transfer or sale of, reproduce, create derivative works from, distribute, perform, display, or in any way exploit all or any part of the Content (including use as part of any library, archive or similar service), or
  • remove the copyright or trademark notice from any copies of the Content made under these Terms.

Any use of the Content not specifically permitted above is expressly prohibited. Requests for permission for other uses may be sent by e-mail to office@incubatoreurope.eu, and permission, if granted, may be conditional upon payment of a fee.


IncubatorEurope reserves the right, in its discretion, to suspend, change, modify, add or remove portions of the Content available on the Website at any time and to restrict the use and accessibility of the Website.


Some content of the Website can only be accessed by creating an account and is subject to a fee. The exact fee will be displayed on the Website (How it Works > Pricing).

The fees mentioned on the Website are expressed in Euro after tax, unless otherwise stated.

Notwithstanding the Company reserves the right to change the fees at any time, any order placed through the Website will be charged at the price applicable at the moment the payment was confirmed.

Payment can be done by credit card (Visa, MasterCard, etc.) or through PayPal.

If your use of the Website is interrupted or terminated by IncubatorEurope or if the Website or any Services associated with it are discontinued for any reason, you will not be entitled to receive a refund of your payment.


You are solely responsible for the confidentiality of your user name, sign-in password and/or I.D. and for all use of and access to any content accessed using your user name and password.

You are obliged to keep this access data (user name and password) strictly confidential in order to prevent unauthorised use of the Website Services. You agree to immediately notify IncubatorEurope if you become aware of any loss or theft of any sign-in password or I.D. or any unauthorised use of a sign-in password, I.D., user name or of the Content or the Website.

You will provide IncubatorEurope with accurate, complete registration information (including your e-mail address) and shall inform IncubatorEurope of any changes to such information.

For the purpose of confirming your compliance with the provisions of these Terms, IncubatorEurope reserves the right to monitor and record activity on the Website, including access to the Content.


Whilst this Website has been designed with great care and is updated regularly, the Website and the information on the Website are provided ‘as is’, without warranty of any kind.  IncubatorEurope does not warrant that the Website will meet the Customer’s requirements or that it will be uninterrupted or error-free nor will it make any warrant on the accuracy, reliability, quality, completeness and currentness of any information on this Website or software or products or services available on the Website.

IncubatorEurope expressly disclaims all warranties, including but not limited to warranties of fitness for a particular purpose, person or organisation and warranties of merchantability. In no event will IncubatorEurope, its partners or other suppliers be liable for direct, special, incidental, or consequential damages (including, without limitation, damages for loss of business profits, business interruption, loss of business information or other pecuniary loss) arising directly or indirectly from the use of (or failure to use) or reliance on the Website Services, even if IncubatorEurope has been advised of the possibility that such damages may arise.

IncubatorEurope does not guarantee the accuracy, content, or timeliness of the Website Services or that they or related systems are free from viruses or other contaminating or destructive properties. In no event will any liability of IncubatorEurope, its affiliates, agents and licensors to you (and/or any third party) arising out of any kind of legal claim (whether in contract, tort, or otherwise) in any way connected with the Website Services, or breach of these Terms by IncubatorEurope exceed the amount, if any, paid by you to IncubatorEurope in respect of the particular Website Service to which the claim relates. Upon IncubatorEurope's request, you agree to defend, indemnify and hold harmless IncubatorEurope from any claims and expenses, including reasonable legal fees, related to any breach of these Terms by you or your use of the Website Services.

Due to the customised nature of the Website Services, return or reimbursement of the Website Services will not be accepted under any circumstances (Directive 97/7/EC on the protection of consumers in respect of distance contracts Article 6.3 (Third bullet point).

In order to check the characteristics and evaluate if the Website Services fulfil the Customer’s expectations, several demo versions of the Website Services are made available.


The information that you provide about yourself to IncubatorEurope will only be used in accordance with IncubatorEurope's Privacy Policy Statement


IncubatorEurope may, in its discretion, terminate or suspend your access to all or part of the Website (including any right to access and use the Content) with or without cause by delivering notice to you.

The rights of termination are in addition to all other rights or remedies of IncubatorEurope, provided in these Terms or by law.


IncubatorEurope, its affiliates and its information providers will not be liable or deemed to be in default for any delay or failure in performance or interruption of the delivery of the Content resulting directly or indirectly from any cause or circumstance beyond its or their reasonable control, including but not limited to failure of electronic or mechanical equipment or communication lines, telephone or other interconnect problems, computer viruses, unauthorised access, theft, operator errors, severe weather, earthquakes or natural disasters, strikes or other labour problems, wars, or governmental restrictions.


Changes to the Terms of use: IncubatorEurope may, at its discretion, change the Terms of use. When the Terms are changed, IncubatorEurope will publish the changes by including them in the Terms of use accessible on the Website. If you use the Website after IncubatorEurope has published or notified you of the changes, you are agreeing to be bound by those changes. Access to certain Content may be subject to additional terms and conditions.

Advertising: Parts of the Website may contain advertising or third party content’s. Advertisers and other content providers are responsible for ensuring that material submitted for inclusion on the Website complies with international and national law. IncubatorEurope is not responsible for any third party’s content or error, omission or inaccuracy in any advertising material. The Website may contain links to other websites. IncubatorEurope is not responsible for the availability of these websites or their contents.

Assignment of Agreement: This agreement is personal to you and your rights and obligations under these Terms may not be assigned, sub-licensed or otherwise transferred. It can only be assigned to a third party by IncubatorEurope.

Notices: Notices to IncubatorEurope must be given in writing by letter and sent to IncubatorEurope's last known registered office.

Severability/Survival/Statute of Limitations: If any provision of these Terms is invalid or unenforceable, such will not render all the Terms unenforceable or invalid but rather the Terms will be read and construed as if the invalid or unenforceable provision(s) are not contained therein. The Parties shall use all reasonable efforts to replace all provisions found to be null and void by provisions that are valid under the applicable law and come closest to their original intention.

Whole Agreement: This Agreement constitutes the entire agreement. Any representation, warranty, term or condition not expressly set out in these Terms shall not apply.

Headings: Headings in these Terms are for convenience only and have no legal meaning or effect.


These Terms shall be governed by, and construed in accordance with Belgian law. The parties irrevocably agree that the courts of Brussels shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms or the legal relationship established by them, and for those purposes irrevocably submit all disputes to the jurisdiction of the Brussels courts.

For the exclusive benefit of IncubatorEurope, IncubatorEurope shall retain the right to bring proceedings as to the substance of the matter in the courts of the country of your residence or, where these Terms are entered into in the course of your trade or profession, the country of your principal place of business.
